White House prospects mix at governor's meeting

MILWAUKEE (AP) ? Health care, budgets and education topped the official agenda for governors at their annual summer summit. But the 2016 presidential race was never far from view or conversation, given the clear White House interest from some in the crowd gathered near Lake Michigan.

With President Barack Obama in his second and final term, the fields for both parties are wide open for the 2016 nominations. There are two years to go before primary campaigning begins in earnest, but prospective candidates are already putting out feelers to determine the support they might draw.

Some of the governors thought to have potential presidential ambitions were a study in contrasts at the Milwaukee meeting.

Republican Gov. Scott Walker of Wisconsin was perhaps the most conspicuous, playing the role of proud host and welcoming his counterparts from around the country to the area where he once served as county executive.

He schmoozed with governors and their families while taking batting practice at Miller Park, home field for Milwaukee's major league baseball team, the Brewers. He sat for private interviews with local and national media and was pressed by dozens of reporters on Friday, the conference's opening day.

Most conspicuously, Walker sported a signature black and orange Harley-Davidson jacket and rumbled through downtown Milwaukee on his own 2003 motorcycle, leading a procession of 100 riders celebrating the 110th anniversary of Wisconsin's iconic motorcycle. He stopped at times for pictures with veterans who joined the rolling thunder.

"It draws more attention to what I'm trying to do in Wisconsin," Walker said in an interview. "You're in the news not for the sake of being in the news. It's for a purpose."

Walker has already developed a national reputation because of legislation he signed in 2011 stripping public employee unions of bargaining power and decisively winning the recall it prompted last year.

Like Walker, New Jersey Gov. Chris Christie also has a national following. His outspoken style, background as a federal prosecutor and image as a Republican who has confronted powerful forces in his Democratic-dominant state have made him a fan favorite.

But Christie could hardly have been less conspicuous in Milwaukee. He was accompanied by few staff, mainly security. Most noteworthy, Christie, who is usually accessible to news media, granted no interview requests.

Approached in a corridor, Christie breezed by, saying "He's not taking questions."

For Christie, the calculation is different than for others with possible presidential ambitions who attended the conference, including Republican Gov. Bobby Jindal of Louisiana and Democrats Gov. John Hickenlooper of Colorado and Martin O'Malley of Maryland. Unlike the others, Christie faces re-election this fall, and keeping his public profile focused on returning to office is a priority. Whatever prospects he may have for the presidential nomination would effectively vanish if he lost re-election.

Like Christie, Jindal kept a low profile. But he made strategic use of his time.

Jindal met with reporters Sunday morning shortly after pulling off the behind-the-scenes coup of the weekend. He had attended a fundraiser in Iowa at the invitation of Gov. Terry Branstad and flew with Branstad to Milwaukee, giving the two an hour of quality chat time. Because of Iowa's early presidential caucuses, Branstad's insight into the state's politics is valued. He also carved out time for Walker and Christie.

"I like all these governors," said Branstad, a veteran Republican. "I want to be a good friend and a good host. And I'll give them my best and honest advice."

Hickenlooper and O'Malley were as different as Christie and Walker. Hickenlooper was content to keep a lower profile, while O'Malley literally seized the spotlight.

At a Democratic Governors Association reception Saturday evening, O'Malley, who plays guitar and sings Irish folk tunes, sat in with the band on stage for several numbers.

News reporters sought out Hickenlooper to discuss his government's response to last year's shootings in a suburban Denver movie theater packed for a midnight screening. Twelve people died in the massacre, including a 6-year-old girl, and 70 were wounded.

Hickenlooper signed legislation this year requiring background checks for all gun sales and stepped-up mental health programs. "We also saw a point of keeping guns out of the hands on dangerous criminals," Hickenlooper said.

But among the Democrats, O'Malley took pains to discuss his views on the state of the country, the only one of the governors to offer insight into a prospective campaign.

"We're going through a time of confusion and polarization and a real crisis about whether or not we are capable as a people of accomplishing big and important things," he told reporters Saturday.

And in doing so, O'Malley signaled candidly he is preparing to run.

"By the end of this year, we're on course to have a body of work that lays the framework of the candidacy for 2016," he said.

Govs. Andrew Cuomo, D-N.Y., and Rick Perry, R-Texas, are also viewed as possible contenders for their party's nomination in 2016. Neither attended the conference.

Overnight Construction Project On George Washington Bridge To Begin Monday

NEW YORK (CBSNewYork) ? Late-night drivers could experience lengthy delays as an overnight construction project on the upper level of the George Washington Bridge?begins this week.

Overnight road work on the New Jersey-bound lanes of the bridge will begin Monday at 11 p.m.

As WCBS 880?s Peter Haskell reported, the GWB is 82 years old and is showing its age.

The Port Authority will be replacing 362 joint panels overnight on weeknights for the next six weeks.

?It?s six feet long and approximately 11 feet wide,? engineer Bernard Yostpille told Haskell. ?With this repair, we are limiting the amount of repair to about 10 percent of the deck area.?

The cranes needed for the project will require three of four lanes to be closed. There will also be some temporary full closures of the upper level of the span, which could lead to extensive delays of up to an hour, the Port Authority said.

Construction will go on from 11 p.m. to 5 a.m., Monday through Friday. On Saturdays, the span won?t re-open until 10 a.m., officials said.

The $82 million project will alternate on a weekly basis between the New Jersey-bound and New York-bound lanes, starting with outbound traffic this week.

The lower level of the bridge, which is usually E-ZPass only in the overnight hours, will accept cash during the construction project.

?Car drivers can get to the lower level, be fully staffed with toll collectors. I would strongly advise that they move down to the lower level,? Cedric Fulton, the Port Authority?s director of Tunnels, Bridges and Terminals, told Haskell.

Trucks must still use the upper level of the bridge.

Iran's new president makes first appointment

TEHRAN, Iran (AP) ? Iran's media says the new president has appointed a U.S.-educated businessman as his chief of staff, his first appointment after taking office.

A Sunday report by the official IRNA news agency says Hasan Rouhani named Mohammad Nahavandian, a 58-year-old businessman with a doctorate in economics from George Washington University in Washington.

Rouhani was elected in June and was endorsed by the country's Supreme Leader on Saturday, allowing him to begin acting as president. He will be sworn in later on Sunday.

In his speech Saturday, Rouhani said his top priority is to resolve economic problems. Nahavandian's appointment is seen as outreach to the private sector.

Iran's economy suffers from international sanctions over its controversial nuclear program, which the West suspects is aimed at developing weapons technology. Iran denies the charge.

GOP candidates for governor meet for their first joint forum

Appearing before a crowd where mention of the Met Council prompted hisses and Minnesota?s coming health exchange elicited groans, the four Republican men who want to occupy the governor?s office trotted out their wares Thursday night.

In their first joint forum appearance, Republican Sen. Dave Thompson, Rep. Kurt Zellers, businessman Scott Honour and Hennepin County Jeff Johnson began to shape the messages they hope will win over Republican activists, then Republican primary voters, then, in 460 days, Minnesotans at the polls.

The more than 100 Republicans gathered to listen at the Mermaid event center in suburban Mounds View made clear that they plan on being tough on those who hope to lead the state.

?We are not going to settle. We are going to demand bold leadership,? said Sue Jeffers, a radio show host who ran against Gov. Tim Pawlenty in 2006. ?We?ve had enough. We're going to hell in a hand basket and this is the election that can turn everything around.?

The candidates generally agreed. They promised that if they were in DFL?Gov. Mark Dayton's office things would be different.

"I?m in this to actually change the direction of government," Johnson said.

Thompson said his first priority would be to ask: "Is this a task that the private sector could do? If the answer is yes, don't have government do it."

"I think we have to start a conversation about the budget with a conversation about results," said Honour.

"I will absolutely fight for jobs and a competitive Minnesota economy. And I won't settle for whatever the soup de jour is today. We want this but a little bit less. It will be a hard cut," Zellers said.

The candidates are still feeling out how they will press their cases, as Zellers admitted early in the event --? ?This is first one by the time we get to the last one we will be much better at what we?re doing,? he told the crowd. But they began to sketch out the profiles they will develop as they move along.

Ackman's Pershing Square takes $2.2 billion stake in Air Products

BOSTON/NEW YORK (Reuters) - Hedge fund manager William Ackman unveiled his biggest bet ever on Wednesday, a $2.2 billion play on Air Products & Chemicals Inc that the billionaire trader kept secret for two months.

The activist investor's Pershing Square Capital Management now owns 9.8 percent of the industrial gas maker, making it the company's biggest shareholder. Pershing Square might have bought even more, but Air Products adopted a "poison pill" defense to prevent a takeover after some on Wall Street began wondering whether the company might be in Ackman's sights.

Speculation mounted earlier this month that Ackman, who tends to make only a few concentrated bets at a time, was laying the groundwork for something big when he set out to raise as much as $1 billion to invest in a company that he called strong but lagging its peers and declined to name.

Pershing Square began buying Air Products stock in early June and Ackman said in a filing that he believes the company to be "undervalued" and an "attractive investment."

In some ways, Air Products may look a little like Canadian Pacific Railway, which the hedge fund also described as a rock solid company that was woefully underperforming.

In the 21 months since Ackman took on Canada's second-largest railway with a $1.4 billion investment, he got seven new directors elected to the board, replaced the chief executive and scored one of his biggest investment successes, making some $2 billion in profit in less than two years.

"We like Air Products because of its defensive characteristics which are beneficial in times of slower economic growth," said James Sheehan, an analyst at SunTrust Robinson Humphrey. But he also said, "the company does lag on several metrics and this is where an activist investor could really improve things."

As word spread on Wall Street that Ackman was trimming his position in Canadian Pacific and readying another big bet, the fund still managed to keep the target's name secret until it had completed buying on Tuesday. It announced the news on Wednesday in a regulatory filing within the 10 calendar day window of owning 5 percent or more in publicly traded company.

To build the new bet quickly, Ackman relied on seven holding companies Pershing Square incorporated in Delaware according to the SEC filing. Most of the entities were incorporated in June.

Over the years, Ackman has used similar entities to accumulate shares in target companies, such as for the big stake he bought in Fortune Brands in 2010.

Air Products, whose rivals include Praxair Inc , France's Air Liquide SA and Germany's Linde AG , said in a statement that it has not been in touch with Ackman, but looks forward to engaging with Pershing Square to understand its views.

Apparently, the Air Products board realized that Ackman - or someone - was interested in the company, in light of heavy stock buying; it adopted a "poison pill" takeover defense.

"The board was paying attention," said Keith Gottfried, a partner at law firm Alston & Bird. "They acted quickly and thoughtfully to protect their shareholders and create a little bit of breathing room."

Traditionally, Ackman starts off with politely worded suggestions for change out of the media's glare, but if his past record sheds any light on the future, he can quickly become demanding. Three chief executives - at JC Penney, Canadian Pacific and Procter & Gamble - lost their jobs not long after the hedge fund manager appeared.

In order to assemble as much financial firepower as possible, Ackman asked his current investors, including pension funds in Massachusetts, New Jersey and Arkansas and Blackstone Group, to consider sending more money for the unnamed target.

He offered a fee cut in exchange for locking up investors' money for three years, suggesting he might need time for his new investment to play out, investors said.

Ackman calls himself a long-term, strategic investor who often sticks with a bet for as much as four years.

The fact that this bet did not leak underscores how skillful some hedge fund managers have become in placing bets and asking to delay the disclosure process by requesting "confidential treatment" from the SEC, under the argument that disclosure might interfere with a business strategy.

Pershing Square has made use of this argument, most recently when it revealing that it had 5.9 million shares of Mondelez International .

For Ackman, the Air Products disclosure comes at a critical time, as he rides a $1 billion short bet against Herbalife Ltd , which Reuters reported is costing the fund some $300 million in unrealized losses.

On Wednesday, as Air Products rising share price helped buoy returns, Ackman was also losing more money on Herbalife amid news that billionaire investor George Soros, a sometime tennis partner of Ackman's, had taken a large long position in the nutrition and supplements company. Billionaire Carl Icahn, a long-time rival, also holds a large long position in Herbalife, which Ackman says is a pyramid scheme. Ailing retailer JC Penney has also weighed on this year's returns, investors have said.

With Air Products shares closing at $108.64 Wednesday - up 2.9 percent on the day and up about 16 percent over the last month - Ackman might be able to show his investors gains for the month and boost his year-to-date performance. Other winners in the portfolio include Procter & Gamble , Canadian Pacific Railway and Howard Hughes Corp .

What Ackman may like about Air Products is that the company has few rivals, and its industrial gas business has lucrative, long-term contracts. However, in recent months it has been hit by high exposure to sluggish growth in Europe, and analysts say it should divest its non-core gas businesses.

Those non-core businesses account for roughly 20 percent of the company's sales, including a chemicals unit and one that caters to computer chip makers.

Kansas meatpacker recalls 50,100 pounds of ground beef

(Reuters) - A Kansas meatpacker has recalled 50,100 pounds of ground beef that may be contaminated with the E. coli bacteria, the U.S. Department of Agriculture's Food Safety and Inspection Service said.

The USDA said on Wednesday evening that routine monitoring had confirmed the presence of E.coli O157:H7 in the meat. It said there had been no reports of illness associated with eating it.

The potentially deadly bacterium can cause bloody diarrhea, dehydration and, in the most severe cases, kidney failure. The very young, the elderly and people with weak immune systems are the most susceptible to food borne illness, the USDA said.

The products were produced on July 18 by National Beef Packing Co of Liberal, Kansas, and shipped in 40-pound to 60-pound cases to retailers, wholesalers, and food service distributors nationwide.

The recalled meat bears the number "EST. 208A" inside the USDA mark of inspection, the department said.

I think people need to relax a little.

BR has stated that the Committee and backroom staff are working on getting in potential targets and the fact that we seemed to match BD's bid for Henrikh Mkhitaryan seems to suggest we do have money to spend. All BR has said today is that he will not be buying dross just for the sake of it - which is fine by me.

As for Kyriakos Papadopoulos, with what Schalke's General Manager has said, it seems perhaps we have submitted a further bid but it does not meet their valuation hence why the GM does not consider it a bid.

I am still confident we will get in another centre-back and attacking midfielder as BR has indicated earlier this window. We just need to be patient. I don't think anyone called Lorenzo Melgarejo, Kolo Toure, Luis Alberto or Iago Aspas so I am sure there are a couple of players that we are looking at that may not even have been discussed on these forums yet and none of us really know what is going on behind the scenes (which is the way it should be).

However, if we fail to sign anyone up to 3rd September, then I would question FSG and BR again as it seems Christian Eriksen and Yehven Konoplyanka are two examples of players who are available and who could move to Liverpool as they seem to be interested in moves to England and in Eriksen's case, a move to Liverpool. If we fail to pick up either of these then I would question why BR does not sign them and then states there was no one available.

What Detroit Pistons' New Additions Mean for 2013-14 NBA Season

The Detroit Pistons have made some noise this offseason by signing forward Josh Smith and bringing back guard Chauncey Billups.

President of Basketball Operations Joe Dumars signed Smith to a four-year deal worth $54 million. More importantly it signifies to Pistons fans that the team is serious about a quick turnaround?and Smith is excited to be a part of it.

"When I first met with Joe, he had me sold from the word go," Smith told Gillian Van Stratt of Mlive.com. "This is a successful organization I've always wanted to be a part of. I've always wanted to be a part of a good organization that has a lot of die-hard fans."

Smith played the first nine seasons of his career with the Atlanta Hawks. During that time he played 52 postseason games, bringing valuable experience to a young Piston club. Over the course of his career he?s averaged over 34 minutes, 15.3 points and eight rebounds per game.

With the addition of Smith, the Pistons have a bit of a log-jam in the front court with Greg Monroe and Andre Drummond.

Smith is a power forward who could be squeezed into the small forward role, where his career .465 field goal percentage could be an issue. On the plus side, the three could make for the tallest frontcourt trio in the NBA.

Vincent Goodwill of the Detroit News reported that Dumars has opened the phones for possible deals, though he?s made it clear Andre Drummond wouldn?t be moving.

"I?m comfortable with this roster, really comfortable. But you can?t shut the door now,? Dumars said told Goodwill. ?It?s the middle of July; it?s a long time before Oct. 1. If something comes up that can get us one step further, we?ll do it.?

Dumars would not declare anyone as ?untouchable?.

Just a day after signing Smith, Dumars brought home a familiar face by signing 37-year-old Chauncey Billups to a two-year deal. The return of ?Mr. Big Shot? provides the Pistons with an established point guard and much-needed veteran presence in the locker room.

Billups clearly isn?t the long-term answer at point guard, but they?re hoping he can provide stability for two-guard Rodney Stuckey and mentor young talents Brandon Knight and Kentavious Caldwell-Pope, the No. 8 overall pick in the draft.

?I think we got a lot of really good young players on the team,? Billups told Vince Ellis of the Detroit Free Press. ?Not a lot of leftovers from when I was here with the exception of Rodney Stuckey, who I think so much of and I?m looking forward to getting back and teaming up with him.?

While only the first year of Billups? deal is guaranteed, Ellis tweeted the team could choose to transition him to the front office when he finally hangs them up.

Billups has only played a total of 42 games with the Los Angeles Clippers over the last two seasons due to injuries. He tore his Achilles during the 2011-12 campaign and was nagged by injuries last season as well.

After being dealt to Denver early in the 2008-09 season, Billups has spent the past four seasons between the Nuggets, New York Knicks and Los Angeles Clippers. Billups is expected to be healthy come the start of this season and is ready to play a leadership role in all facets.

Smith played the first nine seasons of his career with the Atlanta Hawks. During that time he played 52 postseason games, bringing valuable experience to a young Piston club. Over the course of his career he?s averaged over 34 minutes, 15.3 points and eight rebounds per game.

With the addition of Smith, the Pistons have a bit of a log-jam in the front court with Greg Monroe and Andre Drummond.

Smith is a power forward who could be squeezed into the small forward role, where his career .465 field goal percentage could be an issue. On the plus side, the three could make for the tallest front-court trio in the NBA.

Vincent Goodwill of The Detroit News reported that Dumars has opened the phones for possible deals, though he?s made it clear Andre Drummond wouldn?t be moving.

I?m comfortable with this roster, really comfortable. But you can?t shut the door now,? Dumars said told Goodwill. ?It?s the middle of July; it?s a long time before Oct. 1. If something comes up that can get us one step further, we?ll do it.? Dumars would not declare anyone as ?untouchable?.

Just a day after signing Smith, Dumars brought home a familiar face by signing 37-year-old Chauncey Billups to a two-year deal. The return of ?Mr. Big Shot? provides the Pistons with an established point guard and much-needed veteran presence in the locker room.

Billups clearly isn?t the long-term answer at point guard, but they?re hoping he can provide stability for two-guard Rodney Stuckey and mentor young talents Brandon Knight and Kentavious Caldwell-Pope; the No. 8 overall pick in the draft.

?I think we got a lot of really good young players on the team,? Billups told Vince Ellis of the Detroit Free Press. ?Not a lot of leftovers from when I was here with the exception of Rodney Stuckey, who I think so much of and I?m looking forward to getting back and teaming up with him.?

While only the first year of Billups? deal is guaranteed, Ellis tweeted the team could choose to transition him to the front office when he finally hangs them.

Billups has only played a total of 42 games with the Los Angeles Clippers over the last two seasons due to injuries. He tore his Achilles during the 2011-12 campaign and was nagged by injuries last season as well.

After being dealt to Denver early in the 2008-09 season, Billups has spent the past four seasons between the Nuggets, New York Knicks and Los Angeles Clippers. Billups is expected to be healthy come the start of this season and is ready to play a leadership role in all facets.

Samsung Galaxy Nexus Bags Android 4.3 Update And Joins Google Nexus 4

Google?s older Galaxy Nexus receives the official Android Jelly Bean 4.3 update on Monday. Samsung?s Nexus phone follows the LG Nexus 4 and the ASUS Nexus 7. ?

The old, but still decent Google Galaxy Nexus by Samsung is the latest smartphone to receive the Android 4.3 mobile operating system upgrade. Our own smartphone with build number JWR66V with baseband version I9250XXLJ1 fetched the update on Monday. See the image below this post. And similar to Nexus 4, the system update for the Galaxy Nexus is more than 160MB big with similar features such as improved performance, TRIM support, virtual surround sound, enhancement to battery life and more. You can see the full list of Android Jelly Bean 4.3 features here. The update is available on unlocked Galaxy Nexus only, and no word yet about the update for the Verizon Galaxy Nexus variant with Long Term Evolution.

If your Galaxy Nexus is still not updated to Android 4.3, you can ?force download? the file by locating the phone?s ?Google Services Framework? app located at the Apps Section on the Settings native Android application. Force stop the GSF app, clear the app?s data, and open the system update page on the About Phone tab. If successful, Google?s servers will notify you with the system update. The Samsung Galaxy Nexus will automatically reboot and initiate the update process. Galaxy Nexus on Android 4.3 is smoother, offers better display (color calibration), faster response and better apps support.

The Samsung Galaxy Nexus is powered by a dual-core TI OMAP micro-processor clocked at 1.2GHz, PowerVR SGX540 GPU and features 16GB of on-board storage. The older Google handset also features a back-facing 5-megapixel camera, a front-facing video chat camera and boasts a 4.65-inch Super AMOLED display with resolution of?720 x 1280 pixels.

Unearthed Reviews: The Ethernet Man. Four Stars | The RiotACT

Egads, it?s back!

Unearthed Reviews is here, returned from wherever we left it.

When we last saw Unearthed Reviews I was using a random number generator to pick bands off a short list I had made of ACT bands on the site.

That is still what we are doing.

To make it onto the shortlist the bands had to follow three rules.
1. I had to have never heard the band?s music before.
2. They had to have an interesting name.
3. They had to be based in the ACT.

I started with a list of 30 or so bands, making them off as we reviewed them. We are now down to 10.

Today the RNG gave me a 1.

That means I?m reviewing the Ethernet Man.

Here?s what he has to say about himself:

The Ethernet Man is an experimental production android designed to make next-level electronic beats for consumption by robots or humans.

A solid concept.

A robot making music for robots. Well played Ethernet Man, that means if I don?t like it, it doesn?t matter. It?s not for me.

The Ethernet Man doesn?t make music solely for fleshy meatbags like myself.

Here, I found the android?s Facebook Page, this is radical.

However I do like it.

I like a band with a shtick. I like a band that doesn?t take itself too seriously. I like robots.

The music is nice and bassy, but has enough going on that it never gets dull or repetitive.

Each track sounds unique and has something different to offer, I recommend starting with Into The Darkness.

The criticisms I?ve most often made towards bands in these reviews are that everything they do is dull, that there is no point or joy in what they?re doing, and that all their songs sound exactly the same.

None of those criticisms work here, despite The Ethernet Man playing electronica music which is a genre that is often the target of many of those comments.

Well done you crazy android.

Apple Needs To Buy TomTom ASAP

The growing value of mapping and location assets is clear as recently witnessed by Google's (GOOG) $1bn acquisition of Waze. Mapping and related location applications such as monitoring traffic flows is becoming increasingly significant to smartphone makers as a point of competitive differentiation. At the Nokia (NOK) Lumia 1020 presentation, CEO Stephen Elop's focused on the camera as its major point of differentiation. However after the camera it was the Lumia 1020's mapping technology with its augmented reality and ability to work off-line that was the feature most commented on. With mapping and location services growing as a major point of differentiation for smartphone makers, Apple (AAPL) is best advised to purchase the last remaining independent mapping company on the market, namely TomTom (TMOAY.PK). Apple already licenses its mapping and location services content from TomTom.

The map on a smartphone is becoming more than just a global positioning system (GPS). Additional features are being rolled out such as traffic flows, retail opportunities and augmented reality. The next step will be for retailers to be able to advertise directly to potential customers in their vicinity via the mapping technology on the smartphone. This could be powerful. For example a retailer could directly advertise in-store deals to a potential customer walking by.

Mapping and location services are the next growth areas in the smart phone arena. The growth is visible as can be seen with the 19% external sales growth in Q2 2013 delivered by Nokia's HERE mapping business. Google just launched its latest version of Google Maps to much fan fare in the press. Smartphone makers and ecosystems are starting to use their mapping and location services as a point of differentiation to consumers.

From supplier to competitor

As history in the tech space shows, a supplier can quite easily morph into a competitor. The biggest example of this is Samsung, a major supplier of memory to Apple. Samsung eventually became Apple' major competitor in the smartphone space. As a result of this transition from supplier to also being a competitor, Apple has worked hard to ensure memory supply from other players such as Micron's (MU) soon to be completed acquisition Elpida. This same dynamic was the reason that Apple dropped Google in 2012 as its supplier of maps and licensed the digital map library of TomTom instead. Google's Android operating system is the main competitor to Apple's iOS system.

Smartphone battleground

The software and hardware business is getting more integrated in the smart phone space. The software and apps each ecosystem offers is a growing point of differentiation. The fact that the lack of a few apps (namely Instagram, Pininterest, SnapChat) is the most common complaint about the Windows Phone ecosystem demonstrates the potential power of having ownership of these apps by the actual smartphone maker. Hence software and apps is growing as a battle ground for smart phone makers. Mapping and location services now sit squarely in the middle of that battleground.

It is interesting to note that Apple's mapping and location services have been historically seen as source of weakness vis a vis the Google maps experience. This can be partly explained by Apple's approach of amalgamating many different external service providers into its map function. It would be more efficient to bring them all in house and deliver a very high quality competitive product. This article from 2012 refers to some of the issues Apple had with its mapping and location services product as per the view of the consumer. Interestingly Apple announced two deals to bolster mapping, HopStop, and Locationary on July 19th, 2013. Apple is addressing its mapping business and looking to make acquisitions.

Strategic value of mapping

As mapping becomes more significant, the strategic value of owning the mapping content increases. A smartphone maker could find itself in trouble if all the available mapping assets were to be owned by its competitors. The price of licensing TomTom's maps are not such that it would be cost efficient in anyway to acquire the whole company. However it would be a major a competitive issue for Apple if TomTom fell into the wrong hands.

TomTom is the only major provider of mapping content either not owned or heavily tied into one of Apple's smartphone competitors. Nokia has its HERE mapping business and Google Maps through its Android ecosystem is very strongly aligned to several of Apple's competitors such as Samsung. That makes Apple vulnerable if TomTom were to fall into the hands of a competitor at a time Apple is evidently focusing on beefing up its mapping product.

TomTom

TomTom is the market leader in mapping & navigational services with maps that cover 112 countries and more than 3 billion people. The company also has hundreds of millions of probes globally contributing to its traffic service. Effectively TomTom is a software company with mapping, traffic and location services as its key products. It sells this content through a variety of channels to many consumer and corporate customers.

At TomTom's Q2 2013 results conference call, management stated that 38% of TomTom's revenue came from License Deals and Content. The remaining 62% came from hardware, namely Personal Navigation Devices (PNDs) and the new growth area of GPS watches. Investors are bearish on TomTom due to the competition for PNDs from GPS services on smartphones. However the content and licensing side of the business is seeing growth driven by various customer groups.

The Automotive division sells services and content such as maps to car manufacturers world wide including the likes of GM, Audi, Ford, BMW & VW. The business solutions division helps corporate customers manage their commercial fleets through various different software programs.

The Licensing business unit leverages their content to deliver high quality digital maps to customers including other PND manufacturers, internet companies and importantly smart phone manufacturers. This is the division that licenses TomTom's all important mapping content to Apple, HTC, Blackberry, Mapquest amongst others. The list of TomTom's licensing partners is available here. At Q2 2013 results reported on July 25th, the stock was up 5% as the company outperformed with revenues declining by a better than expected 4% and the FY 2013 guidance of E900 - E950m revenues was maintained.

Ultimately TomTom is a content company with maps and traffic as its content which is then sold via various market routes. There is definitely significant value in their content as mapping and location services becomes one of the key differentiators for smart phone makers.

Apple needs to buy TomTom due to the strategic value there is in the company's maps. TomTom owns one of the world's three main mapping libraries at a time when mapping is moving to being a battleground product for smart phones. If a competitor were to buy TomTom, Apple would be left in a position where each of the three global map libraries would effectively be in the hands of one of its competitors namely Nokia, Google and whomever purchases TomTom.

The cost but most importantly the time to rebuild a global map would be extremely high, put Apple at a competitive disadvantage and feeling very vulnerable in the mean time. Note Nokia purchased Navteq which became Nokia's HERE mapping business for $8.1bn in 2007. The more recent comparison in Google's purchase of just the Waze app for over $1bn. Mapping assets are expensive to come by and take years to build.

Given TomTom has a market capitalisation of only $1.2bn with a Net Asset Value of $1.1bn, it is easy to foresee a strategic purchase by Apple in order to avoid the competitive nightmare of all three major mapping assets falling into the hands of Apple's competitors. The rationale for the acquisition of TomTom is driven solely by strategic and competitive reasons. This makes TomTom a great stock to own. The press is starting to pick up on this logic as witnessed by the May 17, 2013 article in the Wall Street Journal.

Apple integrated their software and hardware and produced amazing products. This is the overarching trend in the smartphone space. It begs the question if and when a hardware company like Nokia becomes the hardware division of Microsoft and when a software company like Tomtom become the mapping division of Apple. In the case of the latter, I think that time is soon. Buy TomTom.

?Air rage tribe?: Chinese cabin crew learn kung fu as mobs of ?unstable? passengers attack staff over flight delays

Violent attacks have erupted at airports across China, with passengers venting their rage on hapless staff over a summer of grinding delays.

China has spent billions on building some of the largest and most modern airports in the world, but, much to everyone?s embarrassment, it seems unable to get planes to fly between them on time.

Last month, only 18 per cent of the 22,000 flights out of Beijing?s Capital airport departed on schedule, according to the aviation research company FlightStats, making it the world?s worst major airport for punctuality. Not one Chinese airport managed to get even half of its flights to leave on time.

The delays have seen mobs of angry passengers mount at least eight large protests at departure gates in the past two months, during two of which staff were attacked. There is even a new Chinese phrase for the rampaging hordes: the ?kong nu zu?, or ?air rage tribe?.

On Thursday July 18, more than 30 passengers broke through security and stormed the runway at Nanchang airport after being delayed for seven hours by bad weather.

The weekend before, passengers in Shanghai tried to rip off an attendant?s name badge before hitting her. In the subsequent fracas, two airport staff were injured and three passengers arrested. ?The passengers were very emotional and unstable,? Ni Xuying, one of the injured employees, told state television.

At the end of June, a primary school teacher lost control when her flight from Wenzhou to Beijing was cancelled, slapping and kicking an Air China attendant to the ground. ?I waited there for such a long time. Nobody served me a bottle of water or a piece of cake or anything,? Liu Weiwei said in her defence.

In March, Graham Fewkes, a British businessman based in Hong Kong, told the South China Morning Post he had witnessed cheers when a passenger assaulted a stewardess on a delayed flight to the island of Sanya.

?The other passengers were applauding as the man was hitting her,? he said.

Hong Kong Airlines last year said it had an average of three incidents involving disruptive passengers every week and has introduced training in wing chun, a form of kung fu, for its cabin crew.

The situation at China?s airports is now so volatile that staff have been told not to announce any major delays.

The problems have been caused by a sudden surge in air traffic, flowing into skies that are tightly controlled by the People?s Liberation Army. With only a few permitted routes, issues such as bad weather often force airlines to hold back flights rather than divert them.

The heavy delays are exacting an economic cost. Marco Pearman-Parish at Corporation China, a consultancy that helps companies establish a presence in China, said some 60 per cent of his clients at a recent meeting were considering moving their operations away from Beijing because of the constant problems at the airport. ?The delays are making it impossible to do business,? he said.

India Readies Aircraft Carrier For Aug. 12 Launch

Indian government officials recently told journalists that the first vessel of the country?s Indigenous Aircraft Carrier (IAC) program would be launched Aug. 12. The 45,000-ton, 284-metre INS Vikrant, currently under construction at the Cochin shipyard, is expected to enter sea trials ten months after launch, and would be ready for operational service after another five years, according to a report in Aviation Week. The ship had originally been slated for full operations by 2014, though difficulties with steel supplies and the ship?s gearbox have delayed this until 2018. Aviation Week reports that India?s other aircraft carrier, the 45,000-ton, 262-meter-long INS Vikramaditya, formerly the Russian Kiev-class Admiral Gorshkov, is undergoing trials and will soon join the current sole carrier, the aging INS Viraat, which is approaching retirement. Vikrant is designed as a conventionally-powered short-takeoff but arrested recovery (STOBAR) carrier. Construction of the next ship in the IAC program, INS Vishal, has been delayed, but plans suggest it will weigh-in at 65,000-tons, with a catapult-assisted takeoff, barrier arrested recovery (CATOBAR) configuration.

The U.K porn ban includes more than just porn, according to participating ISP providers that spoke with the Open Rights Group. In addition to the opt-in requirement for porn, ISPs will also automatically ban a slew of other content areas that have nothing to do with porn. TalkTalk, one of the ISPs praised by Prime Minister David Cameron for its "great leadership" in implementing the Homesafe program, has a screen like this, with all of those boxes checked. Note the inclusion of less porny site-types like social networking and dating.?

Other services will have something similar, with "the precise pre-ticked options may vary from service to service," according to Open Rights Group. Since people generally stick with default options, the set-up encourages people to "sleepwalk into censorship," says the Open Rights Group.?

To make matters worse TalkTalk's Homesafe?is run by Huawei,?the controversial Chinese tech company with significant ties to the Chinese government. The partnership has some free-speech groups worried that all of the censorship decisions are going through a foreign government that also happens to have a penchant for suppressing free speech. Both Huawai and TalkTalk employees can decide what websites end up on the blacklists, a cause for concern. "It needs to be run by an organization accountable to a minister so it can be challenged in Parliament,"?Dr Martyn Thomas, chair of the IT policy panel at the Institution of Engineering and Technology, told the BBC.?

College football ? Scott believes $2,000 stipend should be part of upgraded scholarship rules.

Culver City, Calif. ? Pac-12 commissioner Larry Scott sided with other major conference commissioners in acknowledging changes must be made in how business is conducted in college football, but he stopped short of saying the "Big Five" conferences should totally divorce themselves from the NCAA?s current system.

"At the end of the day, a lot of people thought realignment would be the end of the world and then the music stopped and it didn?t look that much different," he said. "I think this is going to be one of those deals."

Scott?s remarks came during the Pac-12 media day at the Sony Pictures Studios in Culver City, Calif.

The scenario in which the Pac-12, SEC, ACC, Big 12 and Big Ten could break away and form their own super league outside of the governing hands of the NCAA sounds like a made-for-the-movies drama, but Scott believes a solution can be made without deconstructing the NCAA.

The sticking point for the big five leagues is a desire to give athletes a $2,000 stipend to help cover the cost of college attendance.

Schools in the smaller conferences have shot down the idea because they say they can?t afford it. However, Scott said he doesn?t like the idea of the smaller schools dictating what the bigger conferences do.

"Conferences like ours, with the amount of money we have coming in, we ought to update and revise how we do things," he said. "I don?t think student-athletes should be paid, but the scholarship rules haven?t changed since the 1970s and that is wrong. There has been a lot of change to college football since then and we have the means to take care of the student-athletes. It is the right thing to do."

Some fear the widening gap between the bigger conferences and the Mountain West, American Athletic Conference, Sun Belt, Mid-American and Conference USA could eventually lead to a time when the Big Five play each other exclusively.

While Scott acknowledged there likely will be fewer games against teams from the Football Championship Subdivision as the strength of schedule becomes more important in the future, he doesn?t think there will be as much of an "us versus them" scenario as some imagine.

"I don?t see any scenario in the next few years where we are only playing amongst the five," he said. "I don?t think that would be healthy. I do think we need more autonomy and more control over the structure of how decisions are made."

Endangered Plants for Sale Online: Are They Legal?

Did you know that it is often legal to buy and sell endangered species of plants through the mail? It?s true. Take, for example, the rare Hawaiian palm tree Pritchardia remota, one of several species collectively known as lou?lu. The tree, like many in its genus, is listed as endangered under the U.S. Endangered Species Act (ESA), but right now there are several for sale on eBay. If those sellers have the right permit, then their sales are both legal and within the goals and scopes of the Endangered Species Act. Unfortunately, new research finds that the commercial trade of endangered plant species rarely lives up to law.

Plant sales and private cultivation are actually encouraged under the ESA, which recognizes that commercial propagation is often essential to the survival of listed species. Individuals can collect endangered plants from the wild (as long as they don?t do it from federal land), raise them and sell either whole plants or seeds. The ESA does have one requirement: sellers must apply for a $100 permit (pdf) from the U.S. Fish and Wildlife Service (FWS) if plants are sold across state lines.

But the first in-depth study of online plant sales has found that many if not most sellers appear to lack this essential permit. The study?conducted by researchers at University of Notre Dame and published May 28 in Conservation Letters?found 49 federally listed plant species for sale on the Internet on eBay and other sites. The researchers, who conducted their searches between October 2009 and January 2011, then compared the listings with permit notices published in the Federal Register. They found that only four sellers, two of which were conservation organizations, had obtained the necessary interstate commerce permits. The remaining sellers all appeared to lack the permit.

Lead researcher Patrick Shirey, a Ph.D. candidate at Notre Dame?s Department of Biological Sciences, first observed this phenomenon while working on an earlier paper about human-assisted colonization of threatened plants under the ESA, which was published in Conservation Letters in December 2009. When researching that paper, he says, ?we noticed that the sellers of Tennessee coneflower and Virginia roundleaf birch didn?t advertise the required permit when offering plants for sale. We wanted to know if commercial trade was common for other listed plants.?

The researchers studied hundreds of plant species, including 753 on the ESA and dozens more that are protected by the Convention on International Trade in Endangered Species (CITES). While many of the plants offered for sale were obviously from cultivated populations, they did observe many species that have been threatened by over-collecting from wild populations. They did not track actual completed financial transactions, only plants offered for sale, nor did they look at sales that did not cross state borders, which would not have required the ESA permit. (Each state has its own laws regarding what plants can and can?t be sold within its borders.)

Shirey and his researchers wrote that collaboration between federal agencies, nurseries and individual plant collectors could help to preserve rare species, but it may require more regulation than exists today. ?I would like to see more collaboration between public and private interests for the benefit of these endangered species,? Shirey says. He points to Australia?s critically endangered Wollemi pine (Wollemia nobilis) as a good example. The tree has fewer than 100 individuals left in the wild, but botanical gardens have propagated it worldwide, and some of the money raised from selling the plants goes into conserving the wild population. A similar program could work, he suggests, with the ESA-listed star cactus (Astrophytum asterias). ?Sales of cultivated star cactus are common? ? with and without FWS permits ? ?but profits do not support wild populations like the sales of Wollemi pine.? Meanwhile, the federal government spent more than $64,000 in fiscal year 2011 (pdf) to study and protect the star cactus in the wild.

Shirey and his fellow researchers indicate that private cultivation of endangered plants does more good than harm, and he points out that buyers who are aware of this issue should be able to tell if an online seller has the correct permit. ?The few sellers that have the permit advertise on their website or with the listing that they do so. For example, Sunlight Gardens sells the threatened Cumberland rosemary (Conradina verticillata), and they give their FWS permit number with the listing. They also send a photocopy of their FWS permit with their order.?

Gavin Shire, public affairs specialist with FWS, told me how important individuals are to plant conservation. ?Some 75 percent of endangered and threatened plant species occur to some extent on private lands, and so their conservation can be significantly affected by activities in those habitats. Private landowners and other citizens can have a positive impact on rare plant conservation, and we encourage them to contact their local Fish and Wildlife Service office, and their State Natural Heritage Program to learn more about what they can do to help.?

As for the sellers operating without permits, they might want to think about spending that $100 to get their affairs in order. Anyone convicted of selling endangered plants without the right permits could face a maximum of one year in prison and a $50,000 fine.

Oh, and by the way, I asked one of the eBay sellers currently selling Pritchardia remota plants if they had the FWS permit. I still await a reply.
